Visa International Ordered Malaysian Blogger to Give up Domain name

the domain name is visa.com.my, more details at http://www.visa.com.my/?q=ordered_to...my_domain_name

I would like to know you guys opinion on the case. Give up or not?

the owner should give it up, whether they can file a lawsuit against u in malaysia or not is one issue. It's wrong from the begining to use visa's trade mark for the website.

if malaysian court does accept such lawsuit, visa's definitely gonna win as "Visa" is a popular trademark.

"Visa" can not consider as trademark, is generic word. If you want to travel to oversea you also need "visa". Everyone can use this word, they don't own that word. This is my opinion. I think will win at least 80%.

I had a bad feeling about this site from the very beginning when I found it. Although I do enjoy reading the blogs there once in a while, I question his true intention. VISA (the company) may argue on the point of bad faith. If the site were about applying a travel visa to visit Malaysia, for example, then he might have a ground for a defense. Good luck to that guy nonetheless.

if Visa company doing like that .. u can make a petition online what?

Finally the case came! I've been waiting and speculating that visa.com.my will be justified someday hehehe.

My suggesttion for this blogger is to give up this name with terms of compensation for the 'goodwill' of this name and existing website. What I mean is: Sell the domain name off for a price they can agree on without going through the court

Google once asked a chinese to give up google.cn but the China goverment ignore Google request, then Google forced to pay 1 million for the domain name.

Unfortunately MYNIC is not like a chinese government but a profit-seeking corporate. I will make a selling offer of RM10k for visa.com.my if I were the blogger (for simple reason: to get a new domain name, new web hosting fee and web promotion & advertisiment fees to get back existing traffic and rebranding fees). I'm sure Visa.com.my would not mind spending 10K for 1 page advertisement in newspaper. Why not a domain name?

well, usually those big companies will send their lawyers first to force/threaten you to give up the domain name. If failed then only they offer money to buy the domain name.

NEGOTIATE! They should pay a reasonable amount, especially in the case where the domain choice is more than just coincidental.

Looks like our firend lost battle. And what jerks these VISA CARD people really are. I will simply keep this in mind but I do not think will make much impact as Malaysians tend to forget easily.
